We’ll begin by providing an overview of the mortgage foreclosure process in Texas, along with a summary of the mortgage servicing landscape. We’ll then discuss the tools attorneys can use under the Real Estate Settlement Procedures Act (RESPA) to correct loan servicing errors that can lead to foreclosure. We’ll particularly focus on correcting Successor in Interest errors affecting heir property owners. We’ll also touch on tools available through certain administrative agencies to address servicing errors. We’ll finish by reviewing some of the most common scams that clients may encounter when facing foreclosure. At appropriate junctures throughout the presentation, we’ll discuss ethical considerations relevant to working with clients who are facing loan servicing errors and scams.
