The complex immigration system can be even more complicated to navigate with clients with diminished capacity. Diminished capacity may affect a client’s ability to participate in their immigration case, applications they may file for themself, or their capacity to file applications on behalf of others. The presentation will equip practitioners with tools to issue-spot in immigration cases involving clients with diminished capacity and assist clients in navigating the immigration process. The presentation will review USCIS and EOIR policy regarding clients with diminished capacity and what documents may be necessary to prepare to support clients with diminished capacity as they navigate these systems. The presentation will also discuss ethical concerns regarding representing either beneficiaries or petitioners with diminished capacity.
