OVERVIEW:
Attendees will learn the current statutory and case law relevant to fulfilling the “Standards of Conduct” delineated under 38 C.F.R. § 14.632, which requires Accredited VA Attorneys, Claims Agents, and VSO Representatives to faithfully execute duties, be truthful in dealings, provide competent representation, and act with reasonable diligence and promptness. At the conclusion attendees should be able   (1). To clearly understand the regulatory requirements of appropriate behavior expected of VA-accredited Attorneys, Claims Agents, and VSO Representatives as delineated 38 C.F.R. §§ 14.632 (a) & (b) by completing case scenarios; (2). To discuss why conduct that may be unethical, fraudulent, deceitful, misrepresent, or dishonest is not beneficial to veterans or their dependents regarding benefits or other rights under title 38, United States Code, or title 38, Code of Federal Regulations; (3). To understand the consequences of unreasonably delaying, without good cause, the processing of a claim at any stage of the administrative process or to engage in, acts or behavior prejudicial to the fair and orderly conduct of administrative proceedings before VA.
